  • Responsible for examining business records of licensees under the following consumer finance state laws:  Alabama Consumer Credit Act (Mini-Code), Alabama Small Loan Act (SLA), Alabama Mortgage Brokers Licensing Act (MBLA), Alabama Pawn Shop Act (APA), and the Alabama Deferred Presentment Services Act (ADPSA)
  • Reviewing business records on-site at the following licensees: finance companies, pawn shops, payday lenders, and mortgage brokers; Interviewing licensee staff regarding their business practices involving consumer lending
  • Reviewing licensee’s federal consumer loan disclosures for compliance with the Truth-In-Lending Act (TILA) and Regulation Z, and the Real Estate Settlement Procedures Act (RESPA) and Regulation X
  • Calculating costs associated with consumer loans for compliance with the maximum finance charges allowed by the applicable state consumer finance law, including interest, credit insurance premiums, points, third-party mortgage-related fees and other authorized transaction fees
  • Analyzing credit insurance claims for adequacy to determine if the consumer has received all the benefits they are entitled
  • Verifying licensee’s accounting system accurately reflects a loan’s payment history
  • Evaluating whether the licensee’s sell of ancillary products and collection activities are abusive towards consumer borrowers
  • Closing the examination by composing a report citing the laws and regulations found to be in violation, attaching supporting documentation with calculations, and discussing the findings with the licensee’s branch manager by explaining the legal requirements and making suggestions for improvements in meeting requirements.
  • Fostering knowledge about other federal consumer finance laws, regulations, tools and calculators by researching training materials, websites supported by HUD and the FTC, and other relevant documents
